Liability Waiver

Waiver of Liability (the “Release”) by the prospective participant (the “Participant”) in favor of Atlantik-Brücke e.V., a non-profit organization existing under the laws of Germany, its directors, officers, employees, volunteers, successors, assigns and agents (collectively, “Atlantik-Brücke”).

I freely desire to participate in the NEW BRIDGE PROGRAM (the “Program”), undertaken for the purposes of education, and to engage in activities related to such Program (the “Activities”). In consideration for my participation in the Program and for other good and sufficient consideration, the receipt and adequacy of which I hereby acknowledge, I hereby knowingly, voluntarily and without duress warrant and represent as follows:

  1. Assumption of Risk: I understand the risks inherent in foreign travel, including but not limited to: criminal activity, public health risks, natural disasters, theft, damage or loss to personal property, accidents, airline disasters, exposure to disease, injury or death.
  2. Waiver and Release: Being fully informed of the risk of the Program and Activities, I, the Participant, release and forever discharge and hold harmless Atlantik-Brücke from any claim, debt, demand or liability that I, Participant, or my heirs, executors, estate, administrators, successor or assigns, may have against Atlantik-Brücke for any bodily injury, personal injury, illness, death, property damage, or other loss that may result from my participation in the Program, Activities and/or travel to, from, or within Europe, including any claims caused by or arising from negligence on the part of Atlantik-Brücke.
  3. Insurance and Medical Treatment: I, Participant, understand and acknowledge that Atlantik-Brücke does not carry or maintain, and expressly disclaims responsibility for providing, any health, medical or disability insurance for the Participant. EACH PARTICIPANT IS EXPECTED AND ENCOURAGED TO CARRY PERSONAL LIABILITY OR HEALTH INSURANCE PRIOR TO DEPARTURE. I further understand and acknowledge that Atlantik-Brücke assumes no responsibility for or obligation to provide medical services (including transport and/or financial assistance) in connection with the Program and the Activities. I hereby release and forever discharge Atlantik-Brücke from any claim whatsoever which may arise on account of any medical services rendered during or in connection with the Program and the Activities.
  4. Cancellation of Program: Atlantik-Brücke reserves the right to cancel the Program at any time for any reason. Atlantik-Brücke further reserves the right to modify the Program at any time for any reason, including for the safety of Participants.
  5. Forum/Choice of Law: I, Participant, acknowledge and agree that this Release shall be governed and construed in accordance with the laws of Germany without regard to its principles of conflicts of laws, and any action brought hereunder shall be brought in the courts of Germany.
  6. Nature of Agreement: I acknowledge and agree that every provision of this Release is intended to be severable. If any provision hereof is illegal or invalid for any reason, such illegality or invalidity shall not affect the validity of the remainder of this Release.

This Release contains the entire agreement of the parties with respect to the subject matter hereof and supersedes any earlier agreement between the parties. This Release cannot be amended, supplemented or modified except by a written instrument signed by Atlantik-Brücke and Participant. 

I, Participant, acknowledge that Atlantik-Brücke, through this provision, has advised me of my right to consult with an attorney prior to signing this Release.
